Express Set Down – London Stansted Airport

1 - Application of Terms and Conditions

1.1 These terms and conditions apply when you enter the designated drop-off / pick-up zone at London Stansted Airport (the “Express Set Down”) to perform a passenger drop-off or pick-up or for any other purpose. The Express Set Down is clearly indicated on signs and road markings.

1.2 When you enter the Express Set Down and/or register for the charge account service, you agree to comply with these terms and conditions, as well as any road traffic laws and airport byelaws as may be applicable.

1.3 Failure to adhere to these terms and conditions may result in enforcement action being taken against you by our third-party enforcement agency, including the issuance of Parking Charges.

1.4 The contract for use of the Express Set Down is made between you and Stansted Airport Limited (company number: 01990920 (the “Airport”). In these terms and conditions, "you" and "your" refer to any person who enters the Express Set Down and/or registers for the charge account service and “we” and “us” refers to the Airport.

1.5 APCOA Parking (UK) Limited (company number: 02572947) (“APCOA”) is authorised by the Airport to manage the Express Set Down, including enforcement of the Express Set Down charges and charge account service on behalf of the Airport (see paragraph 6 below for further information).

2 – Express Set Down Charges

2.1 The charges payable by you are displayed on signage at and around Express Set Down and on our website at www.stanstedairport.com/parking/pick-up-and-drop-off. The full charge is payable on each occasion that a vehicle enters the Express Set Down, unless a discount or an exemption applies (see paragraphs 4 and 5 below).

2.2 The requirement to pay the charge applies 24 hours a day 365 days of the year. The charge must be paid by 23.59 on the day after your visit.

2.3 Payment of the charge does not permit you to wait in the Express Set Down for any longer than is reasonably necessary to drop-off or pick-up a passenger. In the event you overstay the maximum 30 minutes stay period displayed on the signage, a Parking Charge may be issued with additional enforcement actions, including debt recovery.

2.4 Non-payment of the charge in accordance with these terms and conditions or any other breach of these terms and conditions may result in a Parking Charge being issued (see paragraph 6 below).

3 - How to Pay

3.1 The charge is payable online, by automated telephone service, or by autopay functionality, as specified on the signage and on the www.stanstedairport.com.

3.2 Non-payment or late payment may result in a Parking Charge and additional enforcement actions, including debt recovery.

4 - Blue Badge Holders

4.1 Normal charges apply. However, where the passenger being dropped-off or picked-up holds a valid blue badge, you are eligible for an extension to the maximum stay period if reasonably required. Should a passenger hold a valid blue badge and require longer than 15 minutes, please contact a traffic marshal and show them the blue badge.

4.2 Failure to display / notification to the traffic marshal in accordance with 4.1 may lead to additional charges applying should you stay over the maximum stay period. For the avoidance of doubt, the extension to the maximum stay is only available where the passenger being dropped-off / picked-up holds a valid Blue Badge and is not available where it is the driver who holds a blue badge, in which case normal charges and time limits apply.

5 - Other Exemptions

5.1 Exemptions apply to authorised airport operational vehicles emergency service vehicles, and military vehicles, as determined by the Airport.

5.2 The Airport reserves the right to offer discounts to the Express Set Down charge at its discretion. Where eligible, discounts will be applied to a payment unless otherwise stated. The current list of discounts can be found at www.stanstedairport.com/parking/pick-up-and-drop-off/.

6 - Parking Charges Enforcement

6.1 A Parking Charge may be issued to you if you fail to pay the Express Set Down charge in accordance with these terms and conditions or you do not comply with any other requirement of these terms and conditions.

6.2 The Parking Charge must be paid within 28 days from the date of issue to avoid additional charges. A reduced amount may apply if paid within 14 days. If you do not pay the reduced amount within this period, then the full amount will become payable.

6.3 If the Parking Charge is not paid within 28 days from the date of issue, further enforcement action may be taken and you may be liable for additional fees incurred as a result of your non-compliance (including, without limitation, debt recovery costs).

6.4 When you enter the Express Set Down, your vehicle registration details will be identified by Automatic Number Plate Recognition (“ANPR”) for charging and enforcement purposes. In the event of a breach of these terms and conditions, we (via our third-party enforcement agency, APCOA) may use the vehicle registration details to request and obtain details of the vehicle’s registered keeper from the Driver and Vehicle Licensing Agency (“DVLA”). Any registered keeper details obtained from the DVLA will be used solely for the purposes of enforcing the outstanding charges.

7 - Vehicle Security and Liability

7.1 You use the Express Set Down at your own risk. We do not accept liability for damage to your vehicle, or theft of or from your vehicle, whilst in the Express Set Down, unless such loss, damage, or theft is caused by our negligence or the negligence of our agents or employees. Liability is only applicable to the extent that our negligence has caused or contributed to the relevant loss, damage, or theft and is limited as set out at 9.6 below.

8 - Traffic Orders and Byelaws

8.1 These terms and conditions do not replace any traffic orders or byelaws as may be applicable at the Airport.

9 - General Provisions

9.1 Driving responsibly: You must drive carefully and responsibly in the Express Set Down, taking care to be aware of all vehicles and pedestrians.

9.3 Compliance with signage: You must comply with all signage and other instructions from the traffic marshals when in the Express Set Down.

9.4 Prohibited activities: The following activities are not permitted in the Express Set Down, and we reserve the right to refuse access or require you to leave if any of these activities are observed (in the opinion of the Airport, acting reasonably):

(a) Conducting any service work, cleaning, or repairs to your vehicle.

(b) Carrying out any business activity, including selling, hiring, or disposing of your vehicle.

(c) Filling or emptying fuel tanks.

(d) Misusing or damaging any part of the Express Set Down.

(e) Driving dangerously.

(f) Doing or attempting to do anything which is an antisocial or criminal offence.

9.5 Limitation of liability: Nothing in these terms limits our liability in the case of death or personal injury caused by our negligence or in the case of fraud.

9.6 Financial liability cap: Without prejudice to clause 9.5, our total liability to you for use of the Express Set Down shall be limited to an aggregate of £50,000 (fifty thousand pounds).

9.7 Exclusion of indirect loss: We do not accept liability for:

(a) Any indirect or consequential loss; or

(b) Any loss of profit, loss of enjoyment, loss of revenue, loss of data, or loss of earnings.

9.8 Events beyond control: We do not accept liability for any failure to perform our obligations due to events beyond our reasonable control. These include but are not limited to war or threat of war, riots, civil strife, terrorist threats or activity, industrial disputes, natural and nuclear disasters, fire, adverse weather conditions, volcanic eruption, or ash cloud, government regulations, airport closures, and cancellations or changes to flight schedules.

9.9 No refund in specific circumstances: Except as expressly stated, we are not obliged to refund any pre-payment or make any other changes to your Express Set Down payment due to events listed in clause 9.8.

9.10 No variation of terms: These terms and conditions cannot be varied except in writing by us. Nothing said or done by any of our employees or agents can alter these terms.

9.11 Right to amend: We reserve the right to change these terms and conditions at our discretion, but once you have made a payment, the terms and conditions that apply are those that were published at the time of payment.
